Food examination documents for court

Preparing materials, an information letter, a specialist opinion, a court-appointed examination and a review.

Case materials

  • Court name, case number and questions relevant to the examination.
  • The order appointing the examination, if one has been appointed.
  • Contract, specifications, delivery notes, universal transfer documents (UPD), and acceptance, inspection and defect records.
  • Records of storage, transport, sampling and sample movements.
  • Reports, photographs, test records and appendices in their full available form.
  • Information on the batch location, access and changes to the products.

For a motion to appoint an examination

By agreement, an information letter on the feasibility of the study may be prepared, setting out proposed questions, specialist details, necessary objects, sampling conditions, laboratory work and indicative time frame and cost. The letter is not a substantive expert opinion and does not replace the procedural appointment of an examination.

Deliverable and review

Contracted work concludes with a specialist opinion, review or another document specified in the Order Invoice. When appointed by a court, an expert report is prepared under the rules for the relevant proceedings. A review assesses the source materials, methods and justification of conclusions; it does not guarantee a repeat examination, admission of the document into evidence or a particular court decision. The deliverable and acceptance certificate are provided on paper and/or electronically by agreement.

Procedural rules

The court independently assesses the evidence and decides procedural matters. The corresponding rules apply to other types of proceedings. The method of submitting documents is clarified according to the requirements of the particular court.
